Chubb unit beats NJ dental surgeries’ virus cover suit

Law360 (September 3, 2021, 6:00 p.m. EDT) – Chubb ACE American Insurance Co. does not need to cover pandemic losses suffered by a group of New Jersey dental offices due to government restrictions, a federal court has ruled , indicating a virus exclusion in their policies.

U.S. District Judge Noel L. Hillman said Thursday that a “remarkably consistent body of case law” in Garden State favored ACE over nearly a dozen southern Jersey dental offices that have sued the ‘insurer. Hillman also denied the practices’ efforts to stay a decision based on the results of similar lawsuits underway in New Jersey.
